Introduction

Welcome to Golly Express. By creating an account or using any of our services, you accept and agree to be bound by the terms and provisions of this agreement. Please read them carefully.

1. Acceptance of Terms

By accessing our website, using our application, or shipping a package with us, you confirm that you have read, understood, and agree to these Terms of Service in their entirety.

2. Description of Services

2.1. General Scope

Golly Express acts as an intermediary agent for the Customer to facilitate international shipping and procurement. We are a logistics service provider, not a seller of goods. Our services are designed to transport items purchased by the Customer from the United States to Ghana.

2.2. Package Forwarding Service

Upon registration, the Customer is provided with a unique U.S. warehouse address. The Customer may use this address to receive packages purchased from U.S.-based retailers. Golly Express will receive these packages on the Customer's behalf, process them for international export, and forward them to the Customer's designated address in Ghana. Our responsibility for a package begins only when it is successfully delivered and logged into our U.S. warehouse system.

2.3. Concierge Shopping Service ("Shop For Me")

For customers unable to purchase from U.S. retailers directly, Golly Express offers a Concierge Shopping service where we purchase items on the Customer's behalf. This service can be initiated in two ways: (a) the Customer may provide a direct link to a desired product, or (b) the Customer may select an item from product listings and deals displayed within the Golly Express application.

Important: Golly Express is not affiliated with, endorsed by, or in partnership with any of these third-party retailers or platforms. We operate as an independent purchasing agent.

2.4. Disclaimer of Warranty on Goods

Golly Express makes no representations, warranties, or guarantees regarding the quality, authenticity, functionality, condition, or merchantability of the items purchased by the Customer. Any issues or disputes regarding the product itself must be resolved directly between the Customer and the original U.S. retailer.

3. Customer's Obligations

The Customer agrees to:

3.1. Provide Accurate Information

Provide true and accurate information regarding their name, delivery address, and contact details.

3.2. Declare Items Accurately

Provide a complete and accurate description and value for all items being shipped for customs and insurance purposes.

3.3. Comply with Prohibited Items Policy

Adhere strictly to the Golly Express Prohibited Items list. Customer is fully liable for any damages from prohibited goods.

3.4. Pay Fees

Pay all shipping fees, customs duties, and applicable charges in a timely manner per our payment terms.

4. Inspection and Customs

The Customer acknowledges and agrees that:

4.1. Right of Inspection

All packages may be opened and inspected by Golly Express personnel or by any government authorities (such as U.S. Customs, Border Control, or the Ghana Revenue Authority) at any point.

4.2. Customs Control

Golly Express has no control over the decisions or timelines of customs agencies. While we will assist with providing required documentation, the final decision to release a package rests solely with the relevant government authority.

5. Prohibited Items

Shipping prohibited or restricted items is strictly forbidden. A detailed, up-to-date list of prohibited items is available on our website. It is the Customer's responsibility to review this list before shipping. Golly Express is not liable for any loss or cost resulting from the seizure of items that violate this policy.

6. Shipping, Delivery, and Delays

6.1. Delivery Timelines

All transit and delivery times provided by Golly Express are estimates only. We do not provide guaranteed delivery dates.

6.2. The Delivery Process in Ghana

Upon a shipment's arrival in Ghana, Golly Express will manage the customs clearance process. Once cleared, the Customer will be notified and provided with an invoice. Delivery will be scheduled only after payment confirmation.

6.3. Factors Beyond Our Control (Force Majeure)

Golly Express shall not be held liable for delivery failures caused by events beyond our control: acts of God, government actions, customs holds, airline delays, strikes, civil unrest, or adverse weather.

6.4. Customer's Responsibility for Delivery

Customer must ensure availability to receive packages. Failed delivery attempts due to unavailability or payment refusal may result in return to our office and additional storage fees.

6.5. Unclaimed or Abandoned Packages

If a customer fails to pay for and/or collect their package within thirty (30) calendar days of first notification, Golly Express may declare the package abandoned and dispose of contents to recover fees.

7. Liability and Compensation

7.1. Limitation of Liability

Golly Express shall not be liable for any loss, damage, or delay except where directly caused by our proven gross negligence or willful misconduct. Where liability is established, it shall be strictly limited to the lesser of: (a) the item's actual value as supported by verifiable proof; (b) the value declared by the Customer at the time of shipment; or (c) $100 USD, unless additional insurance was purchased.

7.2. Policy on Extended Delays (Declared Loss)

A shipment held by a government agency (e.g., Customs) or that remains in transit without movement for more than sixty (60) calendar days from its date of dispatch shall be considered 'Lost in Transit' for compensation purposes. At this point, the Customer becomes eligible to file a claim under the terms of this Agreement.

7.3. Exclusion of Consequential Damages

In no circumstances shall Golly Express be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, income, or business opportunities.

7.4. Conditions for All Claims

Any payment of a claim by Golly Express is strictly subject to the Customer's fulfillment of the following conditions:

  • The Customer must provide written notice of their claim (for damage, loss, or Declared Loss under clause 7.2) within thirty (30) calendar days of the delivery date or the date the item is declared lost.
  • The Customer must submit all required claim documentation, including proof of value, within forty-five (45) calendar days of the notice.
  • The Customer must have fully paid all charges associated with the shipment.
  • The item(s) must not have been prohibited, improperly packaged, or inaccurately declared by the Customer.

7.5. No Waiver

No employee or agent of Golly Express is authorized to modify or waive any part of this Clause without the express written consent of a Company officer.

8. Payment Terms

Payment for all services, including shipping fees, concierge fees, and customs duties, is due upon invoice. We accept various payment methods as displayed on our platform. Golly Express reserves the right to hold packages until all outstanding payments are settled.

9. Privacy

Your privacy is important to us. Our Privacy Policy is incorporated into these Terms of Service by reference and explains how we collect, use, and protect your information.

10. Modifications to Terms

Golly Express reserves the right to modify these terms at any time. We will provide notice of significant changes, and your continued use of our services after such changes constitutes your acceptance of the new terms.
